In this article, we assume that this construction is affected by gender and class stereotypes. To analyze it, we focus on how lawyers socially construct the legal subject of lowand upper-class women claimants for alimony in Lima, Peru, based on analysis of judicial files and interviews with judges and prosecutors. In the work of lawyers, poor women are portrayed as resigned, blurring them as subjects of law. Although also resigned, upper-class women are resistant as they seek subsistence and quality of life with their pension. Beyond automatisms, being a subject of law is also a social construction that, fed by gender and class stereotypes, conflicts with its formal conception.Los procesos judiciales de pensión de alimentos son comúnmente reducidos a lo económico, asumiendo que la constitución en sujeto de derecho es automática e independiente de lo extrajurídico. En este artículo, partimos de que dicha construcción está afectada por estereotipos de género y clase. Nos centramos en cómo los abogados construyen socialmente el sujeto de derecho de mujeres demandantes de pensión de alimentos de clase baja y alta en Lima, Perú, a partir del análisis de expedientes judiciales y entrevistas a jueces, juezas y fiscales. En el trabajo de los abogados, las mujeres pobres son retratadas como resignadas, difuminándolas como sujetos de derecho. Aunque también resignadas, las mujeres de clase alta son resistentes, pues buscan subsistencia y calidad de vida con la pensión.
