In this sense, the Brasilia Rules are perfectly compatible with the protection of fundamental rights, both in the ordinary and constitutional judiciary. El presente artículo se basa en la premisa de que el juez o jueza constitucional no pueden ni deben olvidar los límites que se deducen de su condición de autoridad, y que tienen el deber institucional de cumplir y hacer cumplir el derecho, así como la obligación de hacer respetar los derechos en general y el acceso a la justicia en particular. En ese sentido, las Reglas de Brasilia constituyen pautas perfectamente compatibles con la protección de los derechos fundamentales, tanto en sede de la judicatura ordinaria como de la constitucional.
