As mentioned previously, the law reduces the surface of existential liberty and restores the organized and stipulated legal freedom of the persons to pursue their own objectives, but within the limits set by each legal order. The aforementioned liberty is considered one of the fundamental rights of persons which is best embodied in the contract and its autonomy. Even though it is considered a key part of private legal relations, private autonomy has no specific or explicit space in State constitutions, which is cause for concern, because the laws prefer to grant a constitutional capacity to one of the expressions of such autonomy, which is the contractual freedom.Una de las instituciones que marca el paso del desarrollo del derecho privado no cabe duda de que es la ayer denominada autonomía de la voluntad y hoy mejor precisada autonomía privada; esto es, aquella libertad de los particulares, reconocida por los ordenamientos jurídicos, de regular sus propias relaciones jurídicas de la forma y manera querida por ellos. El derecho recorta, como bien se ha dicho, la superficie de la libertad existencial y devuelve, como recompensa, la libertad jurídica de las personas, organizada y precisada, para proyectar, perseguir sus propios objetivos, pero dentro de los límites señalados por cada ordenamiento. La indicada libertad está considerada dentro de los derechos fundamentales de las personas y encuentra su mejor plasmación en el contrato, posicionando en esta sede la autonomía contractual.
