However, it is the owners of these digital sites who reject their status as employers, defining themselves as intermediaries between service providers and their clients, intending to evade labor rights. Therefore, the question arises: «Is a Rappi or Glovo delivery person an employee of the company?». We consider that he/she is since he/she is subordinate and remunerated.La aparición de las plataformas digitales trajo consigo cambios sustanciales en la economía mundial, y con ellos un reto jurídico ante las nuevas modalidades de trabajo atípicas, donde los empleadores no son los tradicionales empleadores, sino aplicativos como Uber, Glovo, Cabify, Rapi, etc. Al respecto, en nuestro país, se produjeron varios proyectos de ley que buscaban regular el vínculo entre el servicio prestado y la plataforma digital, bajo la figura de una relación laboral. Empero, son los dueños de estos sitios digitales quienes rechazan su condición de empleadores, definiéndose como intermediarios entre los proveedores de servicios y sus clientes, con el propósito de evadir los derechos laborales. Ante ello, surge la pregunta: «¿Un repartidor de Rappi o Glovo es trabajador de la empresa?».
