description Autism Spectrum Disorder (ASD) involves the combination of various cognitive conditions that make interaction and communication diffi[1]cult for the person who presents it. That is, we are faced with an intellectual deficiency that qualifies as a disability, in accordance with the international instruments that regulate the matter. This situation makes its members vulnerable to ineffective state actions in different areas of development. The impossibility of obtaining a quick and timely diagnosis, through the competent institutions, not only aggravates their psychological condition, but also prevents them from being granted legal treatment according to their needs. Thus, even though, around 2014, in Peru, Law n.o 30150 was enacted, formally dedicated to the protection of people with this disorder and from which the National Plan for People with Autism Spectrum Disorder 2019-2021 was formulated , none of these instruments address access to justice as a relevant aspect to consider for the consolidation of this community in the country. The legislative reality is different in other countries in the region, such as Chile, Bolivia and Mexico, which, following the parameters of the Brasilia Rules, propose normative provisions conventionally appropriate for the treatment of these people in the judicial sphere. Thus, this research aims to identify the main material barriers that in Peru prevent people with ASD from properly accessing justice, and then carry out a comparative analysis from which the areas of opportunity and improvement will be obtained, allowing to structure a lege ferenda approach to the matter.

Es decir, se está ante una deficiencia intelectual que califica como una discapacidad de conformidad con los instrumentos internacionales que regulan la materia. Esta situación hace que sus integrantes se tornen vulnerables en los distintos ámbitos de su desarrollo; por lo demás, solo se encuentra la ineficaz actuación del Estado. La imposibilidad de obtener un diagnóstico célere y oportuno, a través de las instituciones competentes, no solo agrava su condición psíquica, sino que impide que se les otorgue un tratamiento jurídico adecuado para sus necesidades. Así, aun cuando, hacia el 2014, en el Perú, se promulgó la Ley n.o 30150, formalmente dedicada a la protección de las personas con este trastorno, y a partir de la que se formuló el Plan Nacional para las Personas con Trastorno del Espectro Autista 2019-2021, ninguno de estos instrumentos aborda el acceso a la justicia como un aspecto relevante que se debe considerar para la consolidación de esta comunidad en el país. La realidad legislativa es distinta en otros países de la región, como en Chile, en Bolivia y en México que, siguiendo los parámetros de las Reglas de Brasilia, plantean disposiciones normativas convencionalmente adecuadas para el tratamiento de estas personas en el ámbito judicial. Es así como esta investigación pretende identificar las principales barreras materiales que en el Perú impiden a las personas con TEA acceder debidamente a la justicia; luego, se realiza un análisis comparativo a partir del que se obtendrán las áreas de oportunidad y de mejora que permitirán estructurar un planteamiento de lege ferenda sobre la materia.O Transtorno do Espectro Autista (TEA) envolve a combinação de diversas condições cognitivas que dificultam a interação e a comuni cação da pessoa que o possui. Ou seja, estamos perante uma deficiência intelectual, que se qualifica como deficiência, de acordo com os instrumentos internacionais que regulam a matéria. Esta situação torna os seus membros vulneráveis a ações estatais ineficazes em diferentes áreas do desenvolvimento. A impossibilidade de obter um diagnóstico rápido e atempado, através das instituições competentes, não só agrava o seu estado psicológico, como também impede que lhes seja concedido um tratamento jurídico adequado às suas necessidades. Assim, embora por volta de 2014, no Peru, tenha sido promulgada a Lei n.º 30.150, formalmente dedicada à proteção das pessoas com esse transtorno e a partir da qual foi formulado o Plano Nacional para Pessoas com Transtorno do Espectro Autista 2019-2021, nenhum desses instrumentos abordar o acesso à justiça como um aspecto relevante a considerar para a consolidação desta comunidade no país. A realidade legislativa é diferente em outros países da região, como Chile, Bolívia e México, que, seguindo os parâmetros das Regras de Brasília, propõem dispositivos normativos convencionalmente apropriados para o tratamento dessas pessoas na esfera judicial.
