description The purpose of this article is to describe the historical path of the Lima Consulate Court, between the history of maritime mercantile law and the politics of the nascent Peruvian Republic, as well as the antecedent of the independent Chamber of Commerce of Peru. The first part of the paper is concerned with explaining how maritime mercantile law developed and the contribution of Antonio de Capmany to the discipline of legal history in the context of the emergence of the Consulate Courts. Then, the second part deals with a comparative study of the fortresses of Real Felipe and San Juan de Ulúa, in order to explain that the Spanish Crown not only took possession of normative bodies, but also of fortresses, that is, maritime infrastructure that resists the attacks of corsairs and pirates. Finally, it explains the process of integration of colonial and republican history, represented by the loyalty of the Lima Consulate Court to the royalist forces and how the advent of the Republic meant that the Consulate had to adapt to the new political-administrative regime of independence, which resulted in the creation of the Peruvian Chamber of Commerce.

La primera parte del trabajo se ocupa en explicar cómo se desarrolló el derecho mercantil marítimo y el aporte de Antonio de Capmany a la disciplina de la historia del derecho en el contexto del surgimiento de los tribunales del consulado. Luego, la segunda parte se ocupa de realizar un estudio comparado de las fortalezas del Real Felipe y San Juan de Ulúa, para explicar que en el gobierno del mar, la Corona española no solo se agenció de cuerpos normativos, sino además de fortalezas, esto es, infraestructura marítima que resista a los embates de corsarios y piratas. Por último, se explica el proceso de integración del tiempo histórico colonial y republicano, representado por el fidelismo del Tribunal del Consulado de Lima a las fuerzas realistas, y cómo el advenimiento de la República hace que el Consulado tenga que acomodarse al nuevo régimen político administrativo de la independencia, hecho que se tradujo en la creación de la Cámara de Comercio del Perú.O objetivo deste artigo é apresentar os antecedentes históricos do Tribunal do Consulado de Lima, entre a história do direito marítimo mercantil e a política da nascente República Peruana, bem como os antecedentes da Câmara de Comércio independente do Peru. A primeira parte do artigo trata de explicar como se desenvolveu o direito marítimo mercantil e a contribuição de Antonio de Capmany para a disciplina da história jurídica no contexto do surgimento dos Tribunais do Consulado. Em seguida, a segunda parte trata de um estudo comparativo das fortalezas de Real Felipe e de San Juan de Ulúa, a fim de explicar que a Coroa espanhola não só se apoderou de corpos normativos, mas também de fortalezas, ou seja, de infra-estruturas marítimas para resistir ao ataque de corsários e piratas.
