description The study presents the results of a bibliographic review on constitutionalism that was established after the war of independence and that was assumed by the Constituent Congress of 1822. From the perspective of the historiography of law with an interdisciplinary approach, it is proposed a valuation of the role and contribution of women, peasants and Afro-descendants to the political independence of our country. From this, it can be affirmed that the founding of the republic was the product of a complex socio-political process, and that the official and patriarchal history has made invisible the other protagonists, the population sectors historically excluded from the political, legal, economic and constitutional of said Constituent Congress. Thus, it is intended to contribute to the understanding, analysis and critical assessment of the role and contribution of the feminist, peasant and Afro-Peruvian movement in the forging of a Constitutional State of Law and a Republic of equals. It concludes by raising the question of how the patriarchal and asymmetric ideological vision consolidated and established the legality, but not the legitimacy, nor the representativeness of the Constitution of 1823 that justified an unjust, exclusive and unequal Republic, which continues to be a challenge for the country and democratic coexistence.

Desde la perspectiva de la historiografía del derecho con enfoque interdisciplinario se propone una puesta en valor del rol y el aporte de la mujer, el campesino y el afro a la independencia política de nuestro país. A partir de ello, se puede afirmar que la fundación de la república fue producto de un complejo proceso sociopolítico, y que la historia oficial y patriarcal ha invisibilizado a los otros protagonistas, los sectores poblacionales históricamente excluidos del diseño político, jurídico, económico y constitucional de dicho Congreso Constituyente. Así las cosas, se pretende contribuir a la comprensión, el análisis y la valoración crítica del rol y el aporte del movimiento feminista, campesino y afroperuano en la forja de un Estado constitucional de derecho y una república de iguales. Se concluye planteando la cuestión de cómo la visión ideológica patriarcal y asimétrica consolidó y asentó la legalidad, mas no la legitimidad ni la representatividad de la Constitución de 1823, que justificaba una República injusta, excluyente y desigual, la cual sigue siendo un reto para el país y la convivencia democrática.O estudo apresenta os resultados de uma revisão bibliográfica sobre o constitucionalismo que se instaurou após a guerra da independência e que foi assumido pelo Congresso Constituinte de 1822. A partir da perspectiva da historiografia do direito com uma abordagem interdisciplinar, propomos destacar o papel e a contribuição das mulheres, dos camponeses e dos afrodescendentes para a independência política de nosso país. A partir disso, pode-se afirmar que a fundação da república foi produto de um processo sócio-político complexo, e que a história oficial e patriarcal invisibilizou os demais protagonistas, os setores populacionais historicamente excluídos do processo político, jurídico, econômico e constitucional do referido Congresso Constituinte. Assim, pretende-se contribuir para a compreensão, análise e avaliação crítica do papel e da contribuição do movimento feminista, camponês e afro[1]peruano na construção de um Estado Constitucional de Direito e de uma República de iguais.
