Finally, it concludes by questioning the specific nature of the legally protected rights according to a systematic interpretation of the provision that regulates it.Este trabajo realiza un análisis de los fundamentos jurídicos (naturaleza jurídica, aspectos generales y alcances) de la tutela de derechos, novísima institución del ámbito procesal penal, introducida por el artículo 71.o, numeral 4 del nuevo Código Procesal Penal del 2004.
