Sumario:The general objective of this study was to analyze and generate knowledge on the process of transferring sentenced persons, as well as to promote the signing of bilateral or multilateral treaties on the subject within the framework of international judicial cooperation, for the purpose of reintegrating foreign inmates into their country from a human rights perspective. The research methodology was qualitative. Likewise, 7 (seven) national and foreign operators involved in the transfer of foreign inmates were selected for the case study. It also included the research method and the collection of information, using interviews, questionnaire, analysis of documents and information records, as well as the transcription, analysis, interpretation of data, elaboration of conclusions, recommendations and proposal to face the problematic reality. The study made it possible to verify that most of the national and foreign operators involved in the transfer of foreign inmates recognize that the mechanism of transfer of sentenced persons is an adequate method for the execution of the sentence for the reinsertion of foreign inmates to their society of origin, from a human rights perspective. They also recognize that, through the conclusion of treaties on the matter, it will contribute to simplify the procedures for the transfer of foreign inmates, thus optimizing the conditions for their reintegration.
