description En el presente informe jurídico se analizará la resolución N.º 159-2024/SPCINDECOPI, sobre la denuncia presentada por el señor Leónidas Quicaño contra la CMAC Huancayo. La Sala Especializada en Protección al Consumidor concluyó que exigir un poder de representación a una persona con discapacidad, sin haber proporcionado los ajustes razonables necesarios, constituye un acto de discriminación en el consumo. En ese sentido, el objetivo principal de este informe será determinar si es correcto que se haya declarado fundada la denuncia presentada por el consumidor. Por ello, se desarrollará el contenido del principio de igualdad y el principio de no discriminación, con el fin de precisar que la infracción administrativa debe analizarse en consonancia con estos principios. Asimismo, se analizará la prohibición de discriminación en el consumo para determinar cómo se configura esta infracción. Además, se examinarán los derechos de las personas con discapacidad para establecer el alcance de su capacidad jurídica. Posteriormente, se analizará el caso del señor Quicaño para determinar si la exigencia de poderes de representación constituye un acto de discriminación en el consumo Finalmente, se concluirá que es correcta la posición de la Sala, dado que este tipo de exigencia desconoce la regulación actual sobre los derechos de las personas con discapacidad. Es un acto de discriminación en el consumo, porque lo que motiva esta exigencia es el prejuicio de creer que esta persona no tiene capacidad jurídica para manifestar su voluntad.

The Specialized Consumer Protection Court concluded that requiring a power of attorney from a person with a disability, without providing necessary reasonable accommodations, constitutes an act of discrimination in consumer affairs. The primary objective of this report is to assess the validity of the consumer's complaint. Accordingly, it will explore the principles of equality and nondiscrimination, emphasizing that the administrative violation should be analyzed in line with these principles. Moreover, it will delve into the prohibition of discrimination in consumer affairs to delineate how this violation is defined. Additionally, it will scrutinize the rights of persons with disabilities to establish the extent of their legal capacity. Subsequently, it will examine Mr. Quicaño's case to determine whether the requirement for powers of attorney constitutes an act of discrimination in consumer affairs. In conclusion, it will be concluded that the position of the Chamber is correct, given that such a requirement disregards the regulations governing the rights of persons with disabilities.
