description En el presente informe se abordan y desarrollan los principales aspectos jurídicos relacionados a la Resolución N° 005-2015-OEFA/TFA-SEM. En este sentido, se aborda el tema del principio de prevención sobre la seguridad jurídica que deben tener las empresas en el Perú. Además, se abordará el tema de la retribución que la autoridad fiscalizadora puede desarrollar en sus resoluciones en aras de evitar los vacíos legales y que las empresas puedan evadir sus obligaciones. En tal sentido en el presente informe se desarrolla los principios pertinentes con los que se deben trabajar para lograr un equilibrio entre la fiscalización y la actividad económica. Asimismo, se concluye en que debe existir normativa pertinente con la cual se indique que las obligaciones de los titulares mineros deben estar incluidas en sus instrumentos de gestión ambiental. Además, se concluye en que el OEFA puede brindar una mejor cadena de valor en sus resoluciones. Finalmente, también se precisan recomendaciones pertinentes para que se genere un mejor funcionamiento en nuestra legislación.

In this sense, the issue of the principle of prevention on the legal certainty that companies in Peru must have will be addressed. In addition, the issue of remuneration that the supervisory authority can develop in its resolutions to avoid legal loopholes and that companies can evade their obligations will be addressed. In this sense, this report develops the pertinent principles with which work must be done to achieve a balance between control and economic activity.
