Las vacaciones son un derecho constitucional de todos los trabajadores sin distinción. No obstante, su regulación legal y aplicación práctica han evidenciado una serie de deficiencias en claridad sobre el incumplimiento en sí mismo, sus consecuencias y la finalidad que buscarían proteger, lo que puede llevar en ocasiones a contradicciones o interpretaciones que podrían no beneficiar al trabajador afectado en su derecho. En ese sentido, el objetivo central es reconocer y resaltar que la protección normativa sobre las vacaciones debe ser coherente con una finalidad favorable al trabajador, la cual no necesariamente debería ser siempre en términos económicos, debido a que las vacaciones impactan en la salud física y mental de los trabajadores.

Vacations are a constitutional right of all workers without distinction. However, its legal regulation and practical application have shown a series of deficiencies in clarity regarding the default itself, its consequences and the purpose that they would seek to protect, which can sometimes lead to contradictions or interpretations that may not benefit the affected worker in their right.
