description Unos de los problemas en el ámbito del derecho procesal penal, en la actualidad es sobre la imposición de la prisión preventiva en el Perú; por cuanto existe una inadecuada aplicación por parte de los jueces, puesto que al aplicarlas en muchos casos lo realizan sin que concurren los presupuestos materiales, requisitos y principios, establecidos por nuestras normas procesales; así como la jurisprudencia de nuestros tribunales de justicia, por cuanto no realizan un análisis pormenorizados de los mismo llegando a expedirse prisiones preventivas de manera abusiva que linda con la arbitrariedad afectando derechos fundamental cuando una persona es sometida a un proceso penal.
