Estando a lo mencionado, en el presente informe jurídico se procederá a analizar la procedencia del recurso de anulación por motivación inexistente atendiendo a la causal recaída en el literal b) del inciso 1 del artículo 63° de la Ley de Arbitraje, la cual fue invocada por Provias Nacional en el recurso de anulación recaído en la Resolución N° 7 del Expediente N° 00581-2019-0-1817-SP-CO-02. Para dicho efecto, se determinará el estándar de la motivación en el arbitraje a partir de un examen exhaustivo de la jurisprudencia nacional, la normativa aplicable y la doctrina calificada.

Given the above, in this legal report we will proceed to analyze the admissibility of the appeal for annulment due to non-existent reasons, taking into account the grounds relapsed in subparagraph b) of subsection 1 of article 63 of the Arbitration Law, which was invoked by Provias Nacional in the appeal for annulment filed in Resolution No. 7 of File No. 00581-2019- 0-1817-SP-CO-02.
