Uno de los principales argumentos fue la falta de innovación de este tratado, puesto que su contenido ya se encontraría regulado en la legislación nacional. Ante la duda del contenido de las disposiciones de dicho acuerdo, es necesario corroborar los impactos reales, que puede generar en la legislación nacional. De esa manera, se puede determinar la necesidad de contar con dicha ratificación. Uno de los aspectos regulados en el acuerdo es la justicia ambiental. Esta busca que toda persona que sufre impactos ambientales desproporciónales cuente con las herramientas necesarias para reparar los daños sufridos. Considerando que la justicia ambiental es uno de los pilares, este trabajo tiene como objetivo analizar la legislación nacional con relación a la justicia ambiental, a fin de determinar cómo dicho acuerdo podría beneficiar o fortalecerlo. Como resultado, se podrá observar que la regulación actual es una de las más avanzadas de la región. Incorpora gran cantidad de las disposiciones del Acuerdo de Escazú. Además, pueden alcanzarse las exigencias del tratado a través de instrumentos infralegales. En ese sentido, la ratificación del Acuerdo de Escazú, en materia de justicia ambiental, responde a intereses políticos, más que a vacíos o falta de protección de la justicia ambiental.

Even thought, Peru has agreed to this treaty, it decided to reject its adoption formally. The reason was the lack of substance, due to the legal framework has already regulated its content. However, it is important to analyze its provisions in order to determine the impacts in our legal framework. Thus, we can conclude the necessity of its adoption. One of the key elements of the agreement is the environmental justice. This aims to give the necessary legal instrument to any person who suffers an environmental impact. Considering the relevance of the environmental justice, this article intends to analyze and compare the legal framework with the agreement in order to determine the benefits of it. As a result, we can observe that our current legal framework is one of the most advance compared to the region. Also, it has already incorporated some of the rules from the treaty. Besides, we can achieve the agreement purpose through infralegal regulations.
