Más aún, se han identificado ciertas incongruencias entre las disposiciones normativas de seguridad y salud en el trabajo y de protección de datos personales que obstaculizan el adecuado tratamiento de esta información médica de trabajadores a cargo del empleador. El presente artículo académico realiza una investigación explicativa que identifica -en las intrincadas disposiciones normativas y en la ausencia de un diálogo entre las ramas jurídicas involucradas- las principales dificultades para un comprobado estado actual de afectación a derechos fundamentales por la ausencia de una fórmula jurídica certera para el adecuado tratamiento de información médica de trabajadores.

Furthermore, certain inconsistencies have been identified between the regulatory provisions on safety and health at work and the protection of personal data that hinder the adequate processing of this medical information of workers under the employer's care.
