El fundamento a la prohibición a estas cláusulas radica en la regulación contenida en el Código Civil peruano. El presente caso permite analizar el tratamiento y regulación de esta prohibición en el ordenamiento jurídico peruano y en la legislación comparada. Por otro lado, mediante el presente informe jurídico, se pretende cuestionar la calidad de motivación del Tribunal Registral respecto al análisis de estos casos.

According to the resolution, it is concluded that it is feasible to register in the public registry the clauses that limit the power of use and enjoyment of the property; However, this does not occur with respect to clauses that prohibit the disposal of assets. The basis for the prohibition of these clauses lies in the regulation in the Peruvian Civil Code. This case allows us to analyze the treatment and regulation of this prohibition in the Peruvian legal system and in comparative legislation.
