description La complicidad en el delito de Negociación Incompatible ha traído un sinfín de debates en nuestra legislación, pues aún no hay una postura definida para abordar la intervención de un extraneus en el mencionado delito, ya que el tipo penal, al ser de carácter especial, solo responsabiliza penalmente aquel funcionario que se interesa indebidamente en un negocio jurídico determinado (contrato u operación). A raíz del Acuerdo Plenario 3-2016-CJ-116, se estableció que la participación sí es posible en delitos de infracción de deber, sin la ruptura del Título de imputación. Sin embargo, no hay criterios jurisprudenciales que definan cómo atribuir responsabilidad a este extraneus, sin llegar a confundirlo con el interesado que participa en el delito de colusión. Por ello, en el presente artículo, se desarrollará y analizará el bien jurídico protegido del delito de negociación incompatible, su naturaleza jurídica, la diferenciación del injusto con el delito de colusión y los criterios jurisprudenciales al momento de fundamentar un caso sobre complicidad del extraneus.
