Este documento establece un criterio definitorio para la evaluación de las infracciones instantáneas. Además, se analiza y desarrolla un argumento sólido para determinar la responsabilidad administrativa de la Cervecería San Juan S.A. basándose en el tipo de incumplimiento detectado. Es así que se pueden revisar las etapas del proceso administrativo sancionador, logrando identificar una posición determinante por parte de las instancias del Organismo de Evaluación y Fiscalización Ambiental, sobre determinar la responsabilidad administrativa de Cervecería San Juan S.A. debido al incumplimiento legal detectado en la etapa supervisora. En línea a lo anterior, el informe examina los bienes jurídicos afectados, los cuales son la salud y el ambiente, comenzando con el análisis del entorno donde se sitúa la planta cervecera y el flujo de sus efluentes, los cuales desembocan en un cuerpo receptor con características específicas y que frente al cual existe una responsabilidad mayor por la sensibilidad de los cuerpos receptores. En consecuencia, este informe legal ha identificado la importancia de diversos elementos que son cruciales para distinguir los tipos de infracciones y evaluar si la subsanación podría considerarse como eximente de responsabilidad administrativa.

This document establishes a defining criterion for the evaluation of instant infractions. In addition, it analyzes and develops a solid argument to determine the administrative liability of Cervecería San Juan S.A. based on the type of noncompliance detected. Thus, it is possible to review the stages of the administrative sanctioning process, identifying a decisive position on the part of the instances of the Environmental Evaluation and Oversight Agency on determining the administrative liability of Cervecería San Juan S.A. due to the legal noncompliance detected in the supervisory stage. In line with the above, the report examines the legal assets affected, which are health and the environment, starting with the analysis of the environment where the brewery is located and the flow of its effluents, which flow into a receiving body with specific characteristics and for which there is a greater responsibility due to the sensitivity of the receiving bodies.
