La Casación 374-2015-Lima, por medio de la cual Aurelio Pastor fue absuelto de la acusación fiscal como autor del delito de tráfico de influencias simuladas, es un precedente importante no solo para entender cómo el máximo órgano del Poder Judicial, la Corte Suprema, interpreta la naturaleza de este tipo penal, sino también para reflexionar sobre las consecuencias negativas de legalizar este tipo de actos para un grupo selecto de profesionales: los abogados. Por ello, el presente informe, buscará, principalmente, abordar el entendimiento de este tipo penal desde el estudio de los elementos de la tipicidad objetiva, así como desde el análisis de las distintas posturas que se han vertido alrededor del bien jurídico protegido por este delito. Esto último con la finalidad de presentar una nueva postura, pero no por ello menos loable. Del mismo modo, el presente trabajo buscará analizar de forma crítica la aplicación, en el caso concreto, de la causa de justificación “ejercicio legítimo de la profesión”, regulada en numeral 8) del artículo 20 del Código Penal, pues no consideramos acorde legalizar este tipo de conductas. Finalmente, la investigación concluirá intentando responder a la interrogante de si en el caso en específico nos encontramos frente a un delito provocado por parte del tercero interesado. Palabras clave: tráfico de influencias simuladas, bien jurídico, causa de justificación, ejercicio legítimo de la profesión, delito provocado.Cassation 374-2015-Lima, by means of which Aurelio Pastor was acquitted of the fiscal accusation as the perpetrator of the crime of simulated influence peddling, is an important precedent not only to understand how the highest body of the Judicial Power, the Supreme Court, interprets the nature of this criminal type, but also to reflect on the negative consequences of legalizing this type of act for a select group of professionals: lawyers. For this reason, this report will seek, mainly, to address the understanding of this criminal type from the study of the elements of objective typicity, as well as from the analysis of the different positions that have been exposed around the legally-protected right by this crime. The latter in order to present a new position, but no less laudable. In the same way, the present report will seek to critically analyze the application, in the specific case, of the cause of justification "legitimate exercise of the profession", regulated in numeral 8) of article 20 of the Criminal Law, since we do not consider it appropriate to legalize this type of behavior.
