Sumario:The crime of sexual violation through deception typified in article 175 of the Peruvian Penal Code presents an incorrect legislative location, so the objective of this investigation is to postulate a relocation of this crime to the base criminal type of sexual rape in article 170 of the Peruvian Penal Code, using as a means to achieve this the analysis of the concept of “environment” in which the victim cannot give free consent. Thus, through this exercise, the definition of “environment” is expanded as the set of both external and internal conditions that influence the consent of the passive subject, highlighting the internal conditions as those produced within the human mind through the formation of an idea or scenarios in the victim with the purpose of consenting to the sexual act. With this new concept, the crime of rape by deception is included within the base crime of rape. This will make it possible to make visible and criminalize unfortunately normalized behaviors such as stealthing, using the deductive research method for this work.
