Sumario:This legal paper examines the nature of corrupting means in offenses involving corruption of public officials, analyzing the relevance of their materiality in crimes such as influence peddling and bribery, where their presence is essential as a constitutive element of the criminal offense. Through the analysis of Appeal N.° 7-2023, it questions the Supreme Court's interpretation, which considers that corrupting means may be of an immaterial nature. This perspective implies including sentimental situations, such as romantic, friendly, or familial relationships, as corrupt scenarios, thereby advancing the punitive threshold within the criminal attempt and complicating the distinction between social acts and illicit behaviors. A mixed stance, based on Italian doctrine, is presented, advocating the necessity for the materiality of corrupting means but allowing for cases where the corrupting means originate as immaterial, provided that they subsequently take on a material form. This analysis sheds light on the complexity of interpreting regulations in corruption cases and emphasizes the urgency of clarifying the scope of corrupting means within current jurisprudence and legislation. In this way, it seeks a consistent and fair application of the law.
