Both legal doctrine and jurisprudence - shaped by historical, political, and normative contexts - have delineated the contours of this law, giving rise to approaches that range from a formal conception to a substantive one. In this regard, the present article seeks to examine, through the study of the Argentine constitutional system and its reforms, the two predominant conceptions found in national legal doctrine and case law: equality as a “norm” and equality as a “value.” Building on this foundation, a third conceptual proposal is introduced: equality as a “principle,” framed within the theory of fundamental rights developed by German jurist Robert Alexy, which offers a renewed perspective for understanding the issue. Finally, an Argentine judicial decision is analyzed in which these conceptions are confronted, exploring the practical implications of their application in the context of judicial review of constitutionality and conventionality.La igualdad en el derecho se configura como un pilar fundamental de los ordenamientos jurídicos modernos, aunque su contenido, alcance y eficacia siguen siendo objeto de debate. Tanto la dogmática como la jurisprudencia de cada sistema jurídico - condicionadas por sus contextos históricos, políticos y normativos - han establecido los contornos de este derecho, dando lugar a enfoques que oscilan entre una concepción formal y otra sustantiva de la igualdad. En este sentido, el presente artículo propone dar cuenta, a partir del estudio del sistema constitucional argentino y sus reformas, las dos concepciones predominantes en la doctrina y jurisprudencia nacional: la igualdad como “norma” y la igualdad como “valor”. Sobre esa base, se presenta una tercera propuesta conceptual: la igualdad como “principio”, en el marco de la teoría de los derechos fundamentales elaborada por el jurista alemán Robert Alexy, que brinda una nueva perspectiva a la comprensión del tema.
