Furthermore, there is a debate about the role that IA should play in a judge's final decisions, as judicial decision-making often involves subjective and contextual aspects that IA may not fully comprehend. In summary, the balance between automation and human judgment remains a topic of debate in the legal community, something that I aim to elucidate in this article, given the increasing interest in this subject.La Inteligencia Artificial (IA) se utiliza en el proceso penal de diversas maneras. En primer lugar, se emplea para analizar grandes cantidades de datos y evidencia, acelerando la revisión de casos y la identificación de patrones relevantes. Esto puede ser especialmente útil en la detección de delitos financieros, fraudes y otros crímenes complejos. Además, la IA puede ayudar a predecir el riesgo de reincidencia de un delincuente, lo que puede influir en la toma de decisiones sobre la libertad condicional. Sin embargo, la implementación de la IA en las decisiones judiciales plantea desafíos éticos y legales. La falta de transparencia en los algoritmos utilizados y el riesgo de sesgos son preocupaciones importantes. Además, existe un debate sobre el papel que debe desempeñar la IA en las decisiones finales de un juez, ya que la toma de decisiones judiciales involucra a menudo aspectos subjetivos y contextuales que la IA puede no comprender completamente.
