In contrast to a reduced view of the principle of equality as a simple mandate for equal treatment, it proposes a reading that conceives of it as a dual or double rule: one that imposes an obligation to treat equally those in equivalent situations, and another that requires differential treatment when circumstances justify it. This conception allows a better understanding of the structure of the right to equality as a principle that does not prohibit all inequality, but only that which is arbitrary or unjustified. In this sense, the article analyzes how this dual dimension of the principle of equality affects the application of the proportionality test, particularly in the weighing phase, where the interests at stake must be balanced in light of the mandate of substantive equality. It is argued that only by recognizing this complex nature of the right to equality is it possible to ensure effective protection against discrimination, as well as an adequate substantiation of normative distinctions in constitutional contexts.Este artículo ofrece un análisis del derecho a la igualdad reconocido en el artículo 3 de la Ley Fundamental de Alemania, en diálogo con la jurisprudencia del Tribunal Constitucional Federal. A diferencia de una visión reducida del principio de igualdad como simple mandato de trato igual, se propone una lectura que lo concibe como una norma dual o doble: una que impone la obligación de tratar de manera igual a quienes se encuentran en situaciones equivalentes, y otra que exige un trato diferenciado cuando las circunstancias lo justifican. Esta concepción permite comprender mejor la estructura del derecho a la igualdad como un principio que no prohíbe toda desigualdad, sino solo aquella que resulta arbitraria o injustificada. En este sentido, el artículo analiza cómo esta doble dimensión del principio de igualdad repercute en la aplicación del test de proporcionalidad, particularmente en la fase de ponderación, donde se deben equilibrar los intereses en juego a la luz del mandato de igualdad sustantiva.
