THE CHALLENGES THAT THE INTERNATIONAL COURT OF JUSTICE HAS TO FACE

In the article, we will identify some of the challenges that the ICJ has to face during the 75thanniversary of its inaugural session. Throughout the year, the Court has consolidated herself asan effective mechanism to resolve international disputed, however after three quarters of acentury, the time has come to identify which are the aspects that should be updated so that itcontinues to maintain its utility throughout the 21st century. International society has evolved alot since the Court began to function, so I consider that the time has come to study the strengthsand weaknesses that it has, in order to further the strengthening the former and correcting thelatter with the sole objective of adapting this dispute resolution mechanism challenges to beaddressed in the near future.
En este artículo se identifican algunos de los desafíos a los que ha de enfrentarse la CorteInternacional de Justicia en el septuagésimo quinto aniversario de su sesión inaugural. A lolargo de estos años, la Corte se ha consolidado como un mecanismo eficaz de solución decontroversias internacionales, sin embargo, pasados estos tres cuartos de siglo, ha llegado elmomento de identificar cuales son los aspectos que deberían actualizarse para que continuaramanteniendo su utilidad a lo largo del siglo XXI. La sociedad internacional ha evolucionadomucho desde que la Corte comenzó a funcionar, por lo que considero llegado el momento deplantearse sus fortalezas y debilidades con el propósito de reforzar las primeras y subsanar lassegundas con el único objetivo de adaptar este mecanismo de solución de controversias a losretos que habrá de abordar en el futuro próximo.
Dans l'article, nous identifierons certains des défis auxquels la CIJ doit faire face lors de la 75eanniversaire de sa session inaugurale. Tout au long de l'année, la Cour s'est consolidée commeun mécanisme efficace pour résoudre les conflits internationaux, mais après trois quarts desiècle, le moment est venu d'identifier quels sont les aspects à mettre à jour pourcontinue de maintenir son utilité tout au long du 21e siècle. La société internationale a évoluébeaucoup depuis que la Cour a commencé à fonctionner, je considère donc que le moment est venu d'étudier les points fortset ses faiblesses, afin de renforcer le premier et de corriger lece dernier dans le seul objectif d'adapter ce mécanisme de règlement des différendsabordées dans un proche avenir.
