Childhood and the Right to the City: A proposal to study in the poor sectors of Metropolitan Lima

This article offers an epistemiological view for the analysis of economic and sociopolitical conditions in the distribution and agency of urban spaces for children. The article presents a theoretical and practical framework to see the process of intersectionality between childhood and The Right to the City. Based on the documentation of three areas of study: 1) Legal framework for the defense of childhood in Peru. 2) The conceptualization of the right to the city. 3) The subject of law, central objective, inserted in a knot of tension between liberty policies, security and social confinement. The conclusion is that in the context of this global health and economic crisis, deepened by the pandemic, we need democratic methods of investigation, that allow proposals that qualify and relax policies of exclusion and lockdown that today harden, contravening the recognition of full citizenship of children since birth, including children’s right to participate in the community and decide on the issues that affect them.
El artículo ofrece un horizonte epistemológico para el análisis de las condiciones sociopolíticas, económicas y culturales en la distribución y la agencia de los espacios urbanos para la niñez. Propone lineamientos teóricos-conceptuales y metodológicos con una mirada al proceso de interseccionalidad entre las infancias y el Derecho a la Ciudad. Con base en documentación sobre el estado del arte en tres áreas de estudio, esboza: 1) el Marco Jurídico por la defensa de las infancias, en el Perú, 2) la conceptualización del Derecho a la Ciudad, y 3) el sujeto de Derecho, objetivo central insertado en un nodo tensional entre políticas de libertad, de seguridad y de confinamiento social. Concluye que en el contexto mundial de incertidumbre para la realización humana, que tiene su origen en las crisis económica y de salud, profundizadas por la pandemia, se requiere de métodos democráticos de investigación, que permitan plantear propuestas que maticen y relajen las políticas de exclusión y de confinamiento que hoy se endurecen, contraviniendo el reconocimiento de la plena ciudadanía de las infancias desde su nacimiento, incluyendo el derecho de la niñez a participar en la vida en comunidad y decidir sobre los temas que les afectan.
