The enactment of the General Law on the Donation and Transplantation of Human Organs and/or Tissues, Law N.º 28189, and its Regulations, Supreme Decree N.º 014-2005-SA, has aroused the interest of the medical community. This is due to the approach that these regulations, especially the latter, have taken to the medical and legal determination of death. In this context, the author's analysis focuses on Title II of the aforementioned regulation, entitled "Diagnosis of death". El trabajo de investigación presentado a continuación se debe a las observaciones de una realidad poco favorable en la ciudad de Cajamarca. Dicha problemática se basa en la falta de implementación de un sistema de Seguridad y Salud en el Trabajo en los Servicios Generales del Hospital Regional de Cajamarca, poniendo en riesgo la salud física e integridad de los trabajadores. Es así, que el estado Peruano creó la ley N°29783, para tratar de resolver este problema y buscar una mejor relación laboral.
