Any reform in the justice system will have a transitional period, in which new models and procedural mechanisms will be revived, attitudes and new conduct in oral litigation will be adapted that will not only result in the success of the claim and protection of rights, but will make the process more agile, fast, transparent and effective, as is the case with the pilot plan implemented in the Superior Court of Justice of Arequipa, and it is through process management by audiences that the current system of the written process is being changed.

In recent years, we have seen that the adversarial system has shaped the criminal process in various Latin American countries. This fact leads us to question what are the characteristics of this system, what are the benefits in comparison with the inquisitorial system and which is the method of teaching to which the different procedural actors are exposed.In this article, the author develops in a comprehensive manner the main features of the inquisitorial system and the changing paradigm in Latin American towards the adversarial system, and then explains the influence of this system on the trial lawyer. In addition, it addresses the theory of the case as a methodology that allows to adopt strategic decisions and improve the professional performance of the litigant. In recent years, we have seen that the adversarial system has shaped the criminal process in various Latin American countries. This fact leads us to question what are the characteristics of this system, what are the benefits in comparison with the inquisitorial system and which is the method of teaching to which the different procedural actors are exposed.In this article, the author develops in a comprehensive manner the main features of the inquisitorial system and the changing paradigm in Latin American towards the adversarial system, and then explains the influence of this system on the trial lawyer. In addition, it addresses the theory of the case as a methodology that allows to adopt strategic decisions and improve the professional performance of the litigant. As a consequence, there's only once chance for convincing the Judge.This article covers the strategy to be followed in this new process, from the strategy itself to the allegations, in order to generate certainty in the judge whom will solve the case.

The Peruvian republican legal stile has influenced the Spanish and French legal tradition. It was characterized by the formal and textual Justice. Rather, the new legal style is changing the old paradigm and it proposes oral litigation. Now this influences the framework of the Civil Justice. This recent change means adopting the principles of immediacy and the central role of the judge to guide the process. Consequently, this new perspective requires the reorganization of the judicial office and new standards in the Legal Process. The behavior of public officials and lawyers is changing. Some benefits come with this new legal model, for example, it serves to end a judicial dispute in a short time. This article aims to propose a reframing of certain aspects of feminist mobilization for equality in the United States of America in the decades of 1960 and 1970, considering some elements of social movements theory and democratic constitutionalism. It analyzes the ways in which the feminist movement’s narrative succeeded in permeating in the constitutional culture of the United States, changing through it the meaning of the U.S. Constitution. In doing so, it focuses on the strategies used by legal feminism in constitutional litigation, on the efforts for the sanction of the Equal Rights Amendment (ERA), and on the interactions between both processes. It addresses the recent revival of the ERA, as well as its text’s shortcomings. Finally, based on the analysis carried out in previous sections, it provides some arguments in support of a new alternative to the old ERA.

RESUMEN La acción contenciosa administrativa es el derecho que la constitución nos otorga, para cuestionar la función y/o decisión de la administración pública. En el caso de estudio la acción contenciosa administrativa inicia luego de que la solicitud de la accionante es declarada improcedente. En el proceso judicial se discute la nivelación de la pensión de la demandante en mérito a los Decretos Supremos N° 065-2003-EF y 056-2004-EF, que otorgaban una asignación especial por labor pedagógica efectiva. La demandante cesó el año 1991, y se encuentra bajo el régimen del Decreto Ley N° 20530. En el trabajo de investigación, examinaremos el proceso contencioso administrativo sobre el expediente 11870-2011-1801-JR-LA-29, iniciado por JUAN ISRAEL CHIRINOS GUTIERREZ, ante la Municipalidad de Santiago de Surco, solicitando se le atribuya el vínculo laboral correspondiente como Empleado Contratado en función de Encargado de la Sección de Matrimonios desde el 01 de enero de 2007, bajo las órdenes de la secretaria general. Sin embargo, y a pesar de que cumplía funciones de un empleado contratado, La Municipalidad, en pleno ejercicio de su función directiva, surtió el régimen laboral del trabajador al de Contrato de Servicios No Personales desde el 01/02/2008, con el cual se ocultó el verdadero vinculo laboral del empleado.
