description En un mundo tan beligerante como el de hoy, el avance no solo es de la ciencia y la tecnología, sino también, de manera penosa, los distintos aspectos negativos de nuestra vida; es en ese sentido que siendo la violencia un eterno mal que aqueja a la humanidad, esta es cada vez más diversa, de tal suerte que el derecho en el afán de seguirle el paso a la realidad se ve en la imperiosa necesidad de tratar de regular y sancionar los distintos tipos o manifestaciones de esta. De ahí que, observando la realidad, el presente investigador, haya notado que uno de esos tipos de violencia es la alienación parental; por ello es que nuestra investigación ha partido de la siguiente pregunta: ¿Qué argumentos jurídicos sustentará la regulación del Síndrome de Alineación Parental como un tipo de violencia psicológica en el ordenamiento jurídico peruano? Así las cosas, nuestra pregunta nos llevó a plantearnos el siguiente objetivo general: Analizar los argumentos jurídicos que sustentarán la regulación del Síndrome de Alineación Parental como un tipo de violencia psicológica en el ordenamiento jurídico peruano. Finalmente; y, después de haber recopilado la información adecuada y haber encuestado a profesionales especialistas en el tema se ha obtenido la siguiente conclusión primaria: Los argumentos jurídicos que sustentarán la regulación del Síndrome de Alineación Parental como un tipo de violencia psicológica en el ordenamiento jurídico peruano son la proliferación y el avance de formas de violencia que se presentan sobre los niños, lo que demanda un tratamiento especializado de todos estos tipos de violencia; otro argumento es la ausente regulación que sobre la misma existe en nuestro ordenamiento jurídico, lo cual impide una solución adecuada y justa de conflictos que involucran este tipo de violencia; y, otro fundamento es el mejor desarrollo afectivo y emocional del niño, el cual tiene íntima relación con el principio del interés superior del niño; pues, al haber una regulación adecuada se podrá proteger de mejor manera al niño, niña y adolescente.

Hence, observing reality, the present researcher has noticed that one of these types of violence is parental alienation; That is why our research has started from the following question: What legal arguments will support the regulation of Parental Alignment Syndrome as a type of psychological violence in the Peruvian legal system? Thus, our question led us to consider the following general objective: Analyze the legal arguments that will support the regulation of Parental Alignment Syndrome as a type of psychological violence in the Peruvian legal system.
