Summary:This research has been aimed at determining whether, in the overcrowded processing of personal data on the Internet, the right to oblivion is a reasonable and effective stealth constitutional principle to rehabilitate the citizen who has served a sentence mechanism. The research was qualitative, not experimental, with descriptive, interpretive and prospective design, applied to a sample made up of a European court ruling that allowed to be used as instruments bibliographic analysis of legal doctrine, which we sought to systematize, analyze, interpret and synthesize information concerning the principle of resocialization of prisoners and the right to forgetfulness of personal data concerning criminal, court and criminal records that are published on the Internet. The research allowed to conclude that: 1) before the touristed processing of personal data on the Internet, the right to oblivion is a reasonable and effective stealth constitutional principle to rehabilitate the national mechanism has served a sentence, regardless exceptions for recidivism, quality of the subject or importance of the offense charged.
